| TERMS AND CONDITIONS - TOP UP 2 TALK / Just Dial Card By using the Services, you agree to be bound by the following terms and conditions and acknowledge that we provide the Services to you on these terms. You must read and accept (or reject) these terms and conditions as a condition of you using, or relying on, the Services. If you do not accept these terms then you must not use the Services. You acknowledge that continued use of the Services will be deemed to be an acceptance by you of these terms and conditions. You further acknowledge that you have no right to cancel the calling card under the Consumer Protection (Distance Selling) Regulations 2000. Calls are charged per minute. Bill payers' permission must be obtained before sending a text message from a mobile. Text Top-ups must be made from a valid UK mobile number on the T-Mobile or Vodafone or O2 or Orange or Virgin networks. The text message request is for a £5 top-up and will be charged at your standard mobile operator's text rate. If premium text message barring is in operation on your mobile phone attempting to text will not result in a top-up charge but you may be charged your mobile operators standard text rate. Rates and minutes shown are based on the 0845/0207-access number and will be charged at your service providers' lo-call & standard national rates. Generally a confirmation message is sent instantaneously, however very occasionally for example at peak times the mobile networks maybe congested which means that the confirmation message maybe delayed. DO NOT resend the message as you will be charged twice. If after a couple of hours and you have not received the confirmation message please contact our customer services team who will be able to identify what the issue is. Calling subject to availability and these terms are subject to change. Rates are effective from 01/06/04 and may change without prior notice. The international calls will be rounded to the nearest penny. 0800 freephone access is available at an additional 2p per minute to the quoted rates. A 20p/min surcharge will be applied for freephone calls dialed from any payphone. Your mobile phone service provider may charge for access to freephone numbers and charge different rates for access via 0845 numbers. If calling from a mobile phone remember to only press the call or send button after dialing the access number but not again after dialing the destination number. Charging for access numbers by your service provider is from the time of connection to the topup2talk service. Some calls to International mobiles, non-geographic numbers and foreign premium rate numbers are charged at different rates to that of the country. The national call rate does not include non-geographic numbers (e.g. 0645, 0845, and 0870). If a particular phone number account has had no movement (that is either a top up or a call being made) for 90 days or more then we reserve the right to close the account and zero any credit balance that may be remaining. Savings displayed are our best savings over BT Together peak rates from UK mainland before promotions and discounts as of 01/06/2004. Standard is Monday - Friday, 8am - 6pm. The savings exclude impact of BTs minimum call charge and Topup2Talk call connection charge. In respect of liability for death or personal injury arising out of negligence or for any fraud or fraudulent misrepresentation, we hereby disclaim and exclude to the fullest extent permitted by law all liability for any loss or damage whatsoever and howsoever incurred including any faults, damages or maintenance to your Services, or any loss, theft or unauthorised use of your Services, or any direct, indirect, consequential, special or secondary loss or damage including any damage to goodwill or property or with respect to loss of data, income or profits or any loss of anticipated savings incurred by you or any loss or damage arising from the consequences of viruses received by you, whether arising in tort (including negligence), contract or otherwise, and arising out of or in relation to your access to or use of or inability to use the Services, or any software or networks used by you in connection with the Services, or in connection with any failure of performance, error, omission, interruption, defect, delay in operation or transmission, computer virus or line, network or system failure even if Telco or its employees or agents are advised of the possibility of such damages, losses or expenses. You indemnify us against any action, liability, claim, loss, damage, proceeding, expense (including legal costs) suffered or incurred by us, arising from, or which is directly or indirectly, related to (i) your breach or non-observance of any term of these terms and conditions; or (ii) your use of the Services.
